Magnuson Moss Warranty Act
The Magnuson Moss Warranty Act is a Federal law that is sometimes referred to as the "Federal Lemon Law". The Magnuson Moss Warranty Act protects individuals who have purchased personal use consumer goods valued at over $25.00 that come with a warranty, which of course your vehicle would fall under. This law sets forth the rights and remedies for these individuals in the event that they have a defective product that the Manufacturer cannot repair within a reasonable number of attempts. The Magnuson Moss Warranty Act provides protections to the consumer that are similar to the Pennsylvania Lemon Law, but this law is actually quite a bit broader in scope than the PA Lemon Law. The Act sets forth that the consumer may choose a free replacement product or a full refund if the manufacturer cannot comply with its warranty for that specific product. The Act also provides for recovery of Attorney Fees if the consumer is successful in bringing his claim.
The differences between the Act and the Pennsylvania Lemon Law are very important. The most noticeable difference is that the Magnuson Moss Warranty Act also applies to "used" vehicles, as long as a problem occurred with the vehicle while it was under the original manufacturer's warranty. The Act also differs from the PA Lemon Law in that there are no mileage requirements (The PA Lemon Law sets forth that the first occurrence of the defect must occur within the first 12000 miles). A final major difference between the two laws is that the Magnuson Moss Warranty Act applies to vehicles other than personal use automobiles, such as Motorcycles and RV's. The PA Lemon Law does not apply to those types of vehicles.
